The Sixth District Court of Appeal overturned a CEQA Initial Study when the City of Santa Cruz proposed amendment of its general plan to remove restrictions on unleashed dogs at Its Beach. The Court disallowed the City's attempt to consider "net" environmental analysis in deciding whether an EIR was required: "Any potential significant environmental effect triggers the EIR requirement ... even if the plan revisions together provide a 'net' or overall positive for the environment."
