City of Fresno (2008) unpublished C055298 The Third District Court of Appeal upheld a CEQA writ issued by the Fresno County Superior Court, agreeing that the City of Fresno was bound by duly-adopted mitigation measures protecting historic homes in Old Armenian Town adjacent to the new Fifth District Court of Appeal. The Court recognized that mitigation measures are more than "mere recommendation" and cannot be altered without adequate justification for making changes, even if a supplemental EIR is prepared.
