Flanders Foundation v. City of Carmel-by-the-Sea (2012) 202 Cal.App.4th 603

The City of Carmel approved the sale of the historic Flanders Mansion, located within the City's Mission Trails Nature Preserve. The Flanders Foundation challenged the sale on grounds of CEQA violations relating to inadequately-addressed environmental impacts and alternatives to the sale. The Monterey County Superior Court granted the petition and issued a peremptory writ in May 2010. The City appealed and Flanders Foundation cross-appealed.

The Court of Appeal affirmed the judgment in part and reversed the portion of the lower court's ruling relating to environmental review of impacts relating to the Surplus Lands Act.
