City of Carmel-by-the-Sea (2007) Monterey County Superior Court The Monterey Superior Court issued a writ of mandamus requiring the City of Carmel-by-the-Sea to comply with its municipal ordinances preventing its ongoing demolition by neglect of Flanders Mansion, to set aside its EIR for the proposed sale of Flanders Mansion due to failure to adequately analyze and adopt feasible alternatives, and to conduct a vote of the people for any future proposed sale of Flanders since it is within park lands.
